Acceptable Use Policy

1. Introduction

This Acceptable Use Policy explains the rules that apply to your use of the website at www.bidq.co.uk and any associated pages, portals, white-labelled pages, partner-branded pages, forms, upload systems and related digital interfaces operated by or on behalf of Bidq trading as “Bidq” (“Bidq”, “we”, “us” and “our”).

This policy applies to all users of the website and all users of any Bidq service, whether as a guest, customer, subscriber, referrer, introducer or other user.

By accessing or using the website or any Bidq service, you agree to comply with this Acceptable Use Policy.

2. Purpose of the Website and Services

Bidq provides information-based services, including document-led property pack review services, portfolio compliance and monitoring outputs, regulatory update services, related reports, and associated digital tools and content.

You may use the website and services only for lawful purposes and only in a manner consistent with this Acceptable Use Policy, our Terms and Conditions, and any other applicable policy published by us from time to time.

3. Permitted Use

You may use the website and services only:

(a) for your own lawful internal business or personal use, as applicable to the relevant service;

(b) for genuine enquiry, ordering, account management and service use purposes;

(c) in connection with legitimate property, compliance, portfolio or transactional review activity; and

(d) in a manner that does not interfere with, damage, disrupt or misuse the website, services or any other user’s use of them.

4. Prohibited Conduct

You must not:

4.1 Illegal or harmful use

(a) use the website or services for any unlawful, fraudulent, dishonest or misleading purpose;

(b) breach any applicable law, regulation or third-party right;

(c) use the website or services in a way that is abusive, threatening, defamatory, obscene, discriminatory, harassing or otherwise objectionable;

(d) use the website or services in any manner likely to expose Bidq to legal, regulatory or reputational risk.

4.2 Misuse of content or outputs

(a) copy, reproduce, distribute, publish, resell, sublicense, assign, white-label, exploit or commercially reuse any report, output, framework, template, wording, methodology, scoring system, workflow, platform content or other Bidq material without Bidq’s prior written consent;

(b) present any Bidq report or output as your own work or as a regulated legal opinion;

(c) allow any third party to rely on a Bidq report or output where such reliance is not expressly permitted by Bidq in writing;

(d) use any report or output outside the scope permitted by the Terms and Conditions.

4.3 Technical misuse

(a) introduce viruses, trojans, worms, logic bombs, corrupted files or any other malicious or technologically harmful material;

(b) attempt to gain unauthorised access to the website, any server, database, system, account or network connected to the website;

(c) probe, scan, test or bypass security or authentication measures;

(d) use bots, crawlers, scrapers, spiders, harvesting tools or similar means to access, extract, index, monitor or copy website content or data without written permission;

(e) interfere with, damage, overload, disrupt or impair the website, platform infrastructure or any associated systems;

(f) reverse engineer, decompile, disassemble or attempt to derive source code, prompts, internal logic or system architecture from any part of the website or services, except to the extent such restriction cannot lawfully be imposed.

4.4 False or misleading behaviour

(a) impersonate any person or entity;

(b) provide false, inaccurate or misleading account, billing, contact or order information;

(c) submit documents that you know, or ought reasonably to know, are false, manipulated, incomplete in a misleading way or unlawfully obtained;

(d) misrepresent your authority to provide documents or instruct Bidq.

4.5 Unauthorised uploads and submissions

(a) upload any material unless you have the right to provide it to Bidq and to authorise its review and processing;

(b) upload confidential third-party information without proper authority;

(c) upload material containing personal data where doing so is unlawful;

(d) upload unnecessary sensitive or special category personal data where it is not required for the service;

(e) upload any material that infringes intellectual property, confidentiality, privacy or other rights of any person.

4.6 Spam and abuse

(a) send spam, bulk unsolicited communications or promotional material through the website or in connection with the services;

(b) submit repetitive, vexatious or abusive enquiries;

(c) misuse support channels, complaints channels or booking systems;

(d) engage in chargeback abuse or dishonest payment disputes.

5. Account Security

If you hold an account with us, you must:

(a) keep login details secure and confidential;

(b) not allow any other person to access the account using your credentials;

(c) notify us promptly if you suspect unauthorised access or misuse;

(d) ensure that account information remains accurate and up to date.

Accounts are personal to the authorised user or subscribing entity and must not be shared, transferred, sublicensed or otherwise made available to others unless expressly permitted by us in writing.

6. White-Label and Partner Pages

Where you access Bidq through a white-labelled page, partner-branded page or introducer route, this Acceptable Use Policy still applies in full.

You must not:

(a) misuse any partner referral route;

(b) make false statements about the relationship between Bidq and any auctioneer, introducer or partner;

(c) attempt to bypass agreed commercial arrangements dishonestly or unlawfully.

7. Use of Free Materials and Website Content

Any free downloads, guides, checklists, newsletters, educational content or other materials made available through the website are provided for limited informational use only.

Unless we expressly state otherwise in writing, you must not:

(a) copy or redistribute them widely;

(b) alter or remove branding or attribution;

(c) republish them under your own brand;

(d) use them to create competing products or services;

(e) use them in a way that suggests endorsement by Bidq.

8. Monitoring and Enforcement

We may monitor use of the website and services for security, compliance, operational and support purposes.

Where we reasonably believe that you have breached this Acceptable Use Policy, we may, with or without notice:

(a) refuse or remove any upload, submission or content;

(b) suspend or restrict access to the website or services;

(c) pause or terminate an order;

(d) suspend or terminate account access;

(e) cancel bookings;

(f) refuse future orders;

(g) report relevant matters to law enforcement, regulators or other authorities;

(h) take legal action; and

(i) recover losses, costs and expenses arising from the breach where lawful to do so.

9. No Reliance on Improper Use

You must not use the website or any Bidq materials in a way that suggests:

(a) Bidq is providing regulated legal services where it is not;

(b) a solicitor-client relationship has been formed where it has not;

(c) a Bidq report may be relied upon by a lender, investor, purchaser, broker or other third party unless Bidq has expressly agreed this in writing;

(d) Bidq has guaranteed any investment, bidding or transaction outcome.

10. Interaction with Other Policies

This Acceptable Use Policy should be read together with:

•the Bidq Terms and Conditions;

•the Bidq Privacy Policy;

•the Bidq Refund Policy; and

•any other policy or notice published by Bidq from time to time.

If there is any inconsistency between this Acceptable Use Policy and the Terms and Conditions, the Terms and Conditions shall prevail to the extent of that inconsistency.

11. Changes to this Policy

We may update this Acceptable Use Policy from time to time.

Any updated version will take effect when posted on the website, unless stated otherwise.
